    That already exists though, and has done so well before "hate crimes" existed. Motivation, remorse and many other factors are taken into account for most crimes when there is sentencing. There is a general discretion that judges encompass.

    Only when there are mandatory sentences are factors like the above not taken into account.

    On the topic, the hate crime episode of South Park was hilariously awesome.

    What do you mean convicted? It's against the law to say racist things? That's crazy.

    I can understand things like racially motivated assaults/murders, etc carrying a harsher sentence because there are societal issues at stake there in addition to the assault itself (eg often such assaults against people of different sexual orientation or race are designed to intimidate an entire community, etc), but saying something unpopular shouldn't be a crime IMO.

    Ofcourse racially vilifying someone is illegal. At least in Australia.

    It would be legally illogical not to have some form of racial descrimination legislation in place seeing as though racial vilification is a common provoking circumstance, which leads to more crime.

    Or from a perspective more grounded in moral theory, acts of violence at girls tend to invoke stronger emotional reactions in friends, relatives and the general public. So it's likely to cause more overall harm than an attack on a dude.

    To put it another way: what would cause someone more grief- their brother coming home with a black eye or their sister coming home with a black eye?
