Icon9 Scott Raymond Thomas gets 3 years

http://sfgate.com/cgi-bin/article.cg...n200143D84.DTL

I'm really quite sad tonight. Although I haven't see or heard from Scott for about a year and a half, he was always happy to have a chat every now and then. He was a good man, and I'm saddened by his conviction. In my personal opinion, he got framed like Schapelle Corby. I'm just disappointed that the people of Australia couldn't have done more for him. If there's any consolation it's that he's already been in jail for 1 year, so he'll be out in 2 which is great. I can't wait to catch up with him...

Well i rest my case...

I guess he's lucky they didn't call you as a witness....

Seriously, IMO i think he was guilty, and was lucky to get what he did... If they slapped all those other charges on him he would've been looking at alot longer...

if he did it he certainly got off very lightly, if he didn't, at least going through the US justice system like he has isn't as bad as what Corby is facing if she is found guilty.

A no contest court outcome basically means the defence is saying it has no defence for what happened. In other words, they couldn't show any evidence to suggest he wasn't guilty so rather than forcing the prosecution to prove their case, in exchange for a few dropped charges and a lower sentence, the defence effectively gave up.

Imagine a 'no contest' plea as something like;

Prosecution: "YOU DID IT! We know you did it and we have proof"

Defence: "Well I can't show any evidence to contradict your claims so I can't contest them. Can we make a deal in exchange for saving the court's time and money based on some mitigating circumstances?"

So although technically the prosecution didn't get to prove their case, this is saying that the evidence is so overwhelming that they didn't need to.

He did it. Deal with it. Had he insisted on going through with the case, he probaby would have got a much bigger fine and a longer sentence.

What more could the Australian Govt do for these people? This gent has pleaded no contest - not much the Govt can do there. Regarding Corby, the Govt offered to arrange pro bono legal representation by a top QC, with experience in Indonesian law - yet her advisers rejected it. I mean, think what you like about their guilt or innocence, but really I think it's a bit of a cheap shot to blame the Aust Govt.
