You can bat him at No.5 if you want to. There is no rule against it I guess.
I remember that Gooch batted at No.5 for a short while during the early 90s in order to hold the middle order together against Shane Warne and did very well. Eg; 3rd Test: England v Australia at Nottingham, Jul 1-6, 1993 | Cricket Scorecard | ESPN Cricinfo |
