It should, of course, refer to the "European Court of Justice".

Yeah, that sounds unenforceable and would fly in the face of the Kolpak decision. There's no 12 month time limit before a restraint of trade is actionable. I take it that these are ECB 'regulations' that you refer to, that it has never taken steps to 'enforce' and not regulations empowered under statute.
